Foil Terms of Use
These Terms of Use govern your use of Foil, a macOS application provided by Bender Bureau OÜ. By downloading, installing, or using Foil, you agree to these Terms.
License and App Store terms
Foil is licensed, not sold. Your license is limited, non-exclusive, non-transferable, and for personal use on Apple devices that you own or control, subject to the App Store rules that apply to your account.
Unless different terms are presented with Foil in the App Store, Apple's Standard Licensed Application End User License Agreement applies.
Apple Music requirements
Foil uses Apple's MusicKit and Apple Music services. Some or all features may require a compatible Mac, an Apple Account, an active Apple Music subscription, an internet connection, and permission to access Apple Music. Your use of Apple services is also governed by the terms associated with your Apple account and subscription.
App functionality
Foil provides an interface for browsing and playing content made available through Apple Music. Catalog availability, library data, playback, artwork, and other Apple Music features are controlled by Apple and may vary by account, region, subscription, device, or changes to Apple's services.
Bender Bureau OÜ may update, change, suspend, or discontinue Foil or particular features when reasonably necessary for maintenance, security, compatibility, legal, or operational reasons.
Acceptable use
You agree not to:
- Use Foil in violation of applicable law or third-party rights.
- Circumvent security, authorization, subscription, or access controls used by Foil or Apple services.
- Reverse engineer, redistribute, sublicense, rent, or sell Foil except where applicable law expressly permits it.
- Interfere with Foil, MusicKit, Apple Music, or related systems.
Third-party services
Foil depends on Apple Music, MusicKit, the App Store, and other Apple-provided systems. Bender Bureau OÜ does not control those services and is not responsible for their availability, content, policies, or changes. Foil is not an Apple Music service and does not provide the underlying music catalog or subscription.
Intellectual property
Foil, including its software, interface, branding, and original assets, is owned by Bender Bureau OÜ or its licensors and is protected by applicable intellectual property laws. Music, artwork, metadata, Apple trademarks, and third-party content remain the property of their respective owners.
Privacy
Foil's Privacy Policy explains how the app handles data. Read the Foil Privacy Policy.
Disclaimer
To the maximum extent permitted by law, Foil is provided on an "as is" and "as available" basis without warranties of uninterrupted operation, compatibility, error-free performance, or continued availability of Apple services. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by applicable law, Bender Bureau OÜ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of Foil. This limitation does not apply where liability cannot lawfully be limited or excluded.
Termination
You may stop using Foil at any time by deleting the app. Your right to use Foil ends if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
Changes to these Terms
These Terms may be updated to reflect changes to Foil, applicable law, or store requirements. The effective date will be updated when changes are published.
Governing law
These Terms are governed by the laws of Estonia, except where mandatory consumer protection laws in your country of residence provide otherwise.
